Types of Bond and Release
If a bond is going to be offered by the judge at Maricopa County Jail, there is a choice to be made between cash bonds or surety bonds. Other options include pre-trial services, O.R. release, and third-party releases.
Most bonds can be posted at MCSO.org.
**Cash Bonds**
Cash bonds are equal to the amount you must post to get out of jail. For instance, a $50,000 cash bond means you must post $50,000 to secure your release. If you show up for all case proceedings as directed, your $50,000 is returned at the conclusion of the case. However, if you fail to appear as ordered, you forfeit the entire bond amount.
**Surety Bonds**
Surety bonds are more common than cash bonds. In the case of a surety bond, if a judge orders a bond of $50,000, you are required to provide $5,000 to a bondsman. The bondsman then posts the necessary paperwork for your bail. In this arrangement, the $5,000 acts as a ten percent fee for the bondsman's services and is not refundable, making it a preferable option for those who cannot afford to tie up $50,000 all at once.
**Pre-Trial Services**
Pre-trial services, also known as PTS, may be mandated by the judge. This means there won't be a set bond, but electronic ankle monitoring is likely to be required. These monitors utilize GPS for geo-location or a SCRAM unit for monitoring alcohol levels through skin perspiration, which is particularly common in felony DUI cases.
**O.R. Release**
An O.R. release, or release on your own recognizance, is typically granted when you have no prior issues with the courts or the criminal justice system. However, if you do not appear as ordered, there will be serious consequences.
**Third-Party Release**
A third-party release involves a third party, such as a parent, taking responsibility for ensuring your attendance at future court appearances.
