Types of Bond and Release in Arizona

If a bond is going to be offered by the judge at Maricopa County Jail, you will need to choose between cash or surety bonds. Other options include pre-trial services, O.R. releases, and third-party releases.

Most bonds are posted at MCSO.org, which can connect you with a bondsman in Phoenix.

Cash Bonds

Cash bonds equal the amount you must post in order to get out of jail. For instance, a $50,000 cash bond means you need to post $50,000 to leave jail. Once you attend all your case proceedings as directed, your $50,000 is returned at the end of the case. However, if you fail to show up as ordered, you forfeit your bond amount.

Surety Bonds

Surety bonds are more common than cash bonds. With a surety bond, if a judge orders $50,000, you will provide $5,000 to a bondsman. The bondsman then posts a paper for your bail. By using a Phoenix bondsman, you are effectively paying him the $5,000 as a ten percent fee for posting your bail. This option is preferable for many who cannot tie up $50,000 all at once, although the $5,000 is never returned.

Pre-Trial Services

Pre-trial services, also known as PTS, may be ordered by the judge. This means there will not be a set bond, but electronic ankle monitoring will likely be required. These monitors use GPS for geo-location or a SCRAM unit to monitor alcohol through skin perspiration, which is common in felony DUI cases.

O.R. Release

“O.R.” stands for being released on your own recognizance. An O.R. release is typically granted if you have not had prior issues with the courts or the criminal justice system. However, failing to appear as ordered can lead to serious consequences.

Third-Party Release

A third-party release requires a third party, such as a parent, to be held accountable for your future court appearances.
